和谐社会建构中的少数民族习惯法与国家法

各民族经济发展水平和传统的差异决定了少数民族习惯法存在并实际地发挥秩序维持功能的必然性。少数民族习惯法在弥补国家法有限性的同时,又和国家法发生冲突。在国家法制统一的要求下,少数民族习惯法应受到国家法的检视和制约,其中不符合法律和行政法规基本原则的部分应受到否定。市场力量的作用以及国家法制统一的要求,决定了少数民族习惯法逐渐被国家法取代是不以任何人的意志为转移的。

The Ethnic Common Laws and Constitutional Law in the Construction of the Harmonious Society

The differences in economy and traditions of ethnic peoples have made inevitable their common laws which actually function in order maintenance. However, the ethnic common laws, while somehow making up the deficiency of constitutional law, are quite often in conflict with it. Still, the ethnic common laws must be subjugat- ed to the constitutional law and any contents in conflict with the constitutional law must be removed. The ethnic common laws will certainly be replaced by the constitutional law considering the practical situation and the requirements of the state legal system.
