网络支付相关市场界定困境纾解

摘    要:双边市场条件下的网络支付平台面临复杂的竞争约束。受正交叉网络外部性、极强的双边互补性、非对称的倾斜定价结构等因素影响,将传统的相关市场界定方法直接应用于网络支付平台具有局限性,需要做出调整与更新。基于网络支付行业的特殊性及整个支付服务市场的发展阶段,界定相关商品市场可采取近期和远期两种应对方案:近期可根据网络支付所服务的交易场景,以需求者对支付服务功能、用途的实际需求为判断依据;当网络支付行业发展到成熟阶段,可在远期运用集群市场方法,将平台多种支付服务以集群的形式放入同一个相关市场考察。在相关政策的管制下,相关地域市场应以国内市场为主。技术创新因素对相关时间市场的影响应当被特别考虑。

Abstract:Under the theory of two-sided markets, online-payment platforms are subject to complex competition constraints. Due to reasons including positive cross-side network externalities, strong bilateral complementarity, and asymmetric pricing structures, a direct application of the conventional methodology for relevant market definition to online payment platforms shows its limitations and therefore needs to be adjusted and developed. Based on the distinct features of the online payment industry and the stage of development of the entire payment service industry, two options, short-term and long-term, can be taken as the methodologies for the definition of relevant product market. In the near future, it can be defined by the actual demand of the consumers for the functions and uses of payment service according to the transaction scenarios where online payment provides services. In the long term, when the online-payment industry has developed to a mature stage, the cluster market method, considering various payment services of the platform as the same relevant market in the form of clusters, can be adopted. Under the control of relevant policies, the geographical market should be restricted to the domestic market in general. The impact of technological innovation on the relevant temporal market should be given extra consideration.
