网络犯罪二分法下的刑法解释问题研究

按照刑法规范文本的不同,可以将网络犯罪分为网络化的传统犯罪与专门的网络犯罪，这种网络犯罪二分法在刑法解释问题上呈现出种种差异。网络化的传统犯罪更倾向于法益侵害说、实质解释、客观解释、扩张解释，而专门的网络犯罪则更倾向于规范违反说、形式解释、主观解释、限缩解释。在解释的误区上，网络化的传统犯罪极易架空构成要件要素，因此需要采用形式解释的方法进行出罪；而专门的网络犯罪则易忽略法益侵害程度，因此需要借助实质解释的方式进行解释出罪。在对这两类网络犯罪进行刑法解释时要警惕“刑法万能论”的误区，采取多种手段治理网络危害行为。 

Research on the Interpretation of Criminal Law under the Dichotomy of Cybercrime

According to the different texts of criminal law, cybercrime can be divided into networked traditional crime and specialized cybercrime. This dichotomy of cybercrime shows various differences in the interpretation of criminal law. Traditional cybercrime is more inclined to the theory of infringement of legal interests, substantive interpretation, objective interpretation and expansion interpretation, while special cybercrime is more inclined to the theory of normative violation, formal interpretation, subjective interpretation and limited interpretation. In the misunderstanding of interpretation, the traditional network crime is very easy to overhead the constituent elements. Therefore, it is necessary to use the method of formal interpretation to explain the crime, while the special network crime is easy to ignore the degree of infringement of legal interests. Therefore, it is necessary to explain the crime using substantive interpretation. When interpreting the criminal law of these two types of cybercrimes, we should guard against the misunderstanding of the omnipotent theory of criminal law and take a variety of means to control the harmful behavior of the network.
