论我国产品质量管理立法的完善

产品质量管理法是我国产品质量法的主要部分。但产品质量管理法从立法体例到具体制度均存在许多问题。完善产品质量管理法的思路是：将产品质量管理法从产品质量法中独立出来；建立以技术监督部门监管一般产品和以食品、药品等部门监管食品、药品等特殊产品的管理体制；合理地确定产品抽查的范围，科学地确定产品抽查的标准，强化产品质量抽查结果的公示制度；增加缺陷产品的召回制度；明确政府的产品质量行政责任，加大行政处罚的力度，完善行政处罚的手段和措施。

The Improvement of China's Product Quality Management Legislation

The product quality management law is important part of product quality law in China. However, it has some defects from the legislative style to the specific regulation. Considering the improvement of China＇ s product quality management law, it is thus suggested that the product quality management law be separated from the product quality law, that a management system be established under which the technical administration supervises general products and food and drug administration supervises special products like food and drugs, that sampling quality supervision be enhanced and strengthened properly and scientifically, that the defective products recall system be supplemented, and that the administrative responsibilities of government for product quality be further specified, reinforcing administrative punishment mechanism.
