| 摘 要： | 扩大罚金刑的适用范围必须建立在坚实的刑罚理论基础上.根据配刑的报应与功利相统一的理论,对于各种贪利性犯罪、侵害财产性犯罪、轻缓的犯罪以及过失犯罪,都应当规定罚金刑;根据刑罚谦抑的理论,罚金刑的适用范围可以突破刑罚报应性的规定,对凡是适用罚金刑就可以实现个别预防的犯罪,都应当规定罚金;根据犯罪学和刑罚作用的相关理论,对于主要是由于社会环境而直接造成的犯罪,应当规定罚金刑.我国罚金刑适用范围应当进一步扩大,对于各种较轻的故意犯罪和过失犯罪,应当规定罚金刑.

| Abstract: | Broadening the range of application of fine must be laid on the firm foundation of penal theory . According to the theory of the unity of retribution and utility in the distribution of penalty , the fine can be applied to greedy crimes , property crimes ,delict crimes and negligent crimes . According to the theory of economy involving penalty , the fine can be applied to the crimes that the fine can achieve the aim of special prevention of crime . According to the theory of the cause of crime and the function of penalty , the fine can be applied to the crimes that are created mainly by social environment . The range of application of fine must be broaden in China. The fine can be applied to minor delict crimes and negligent crimes . |
