| 摘 要： | 行为在现代刑法学中处于基础地位.解读大陆法系行为理论,刑法中的行为、犯罪行为以及"犯罪构成客观要件中的行为"分别属于行为的不同层次.刑法中的行为概念应当重新诠释为行为人控制或应该控制的客观条件作用于具体人或物的存在状态的过程.

| Abstract: | The act is situated in the basic position in the science of the modern criminal law.From the study on the theories of act of the continental law system,the act in the criminal law,the criminal act and the act of the constitutive elements of crime belong to different levels of act.The concept of the act in the criminal law should be one process that the actor control or must control objective conditions that affect the states of men or things. |
