| 摘 要： | “罪、功、刑相适应”要求犯罪、重大立功和刑罚三者之间的均衡。认定重大立功,应当将犯罪分子所立的功与其所犯的罪进行功、罪比较,动态分析,做到功、罪均衡、相当。犯罪后自首又有重大立功表现的减轻处罚时,应当是在其犯罪所应当判处的具体刑罚所在的具体法定刑幅度以下判处刑罚,做到罪、功、刑相适应。
