| 摘 要： | 国家机关及其工作人员的民事赔偿责任与国家赔偿责任是两种性质完全不同的法律责任。我国《民法通则》和《国家赔偿法》对国家机关及其工作人员因职务侵权行为所应承担的责任分别规定为民事赔偿责任和国家赔偿责任,这种立法上的冲突应尽快解决。建议在制定民法典时对《民法通则》的相关规定作修改或废止。

| Abstract: | The civil compensation responsibility of the state organs and their personnel and the state compensation responsibility are totally different lawful responsibilities in nature. China's "The Pinciples of Civil Law" and "The State Compensation Law" stipulate that the state organs' and their personnel's responsibilities for the post encroachment of right are regarded as the civil compensation responsibility and the state compensation responsibility respectively. This kind of conflict in legislation should be settled as soon as possible. It is suggested that the relevent stipulations in "The Principles of Law" must be revised or abolished in working out the civil code. |
