论孙中山的"以人就法"思想

“以人就法”是孙中山在批判地继承中国古代“法治”思想中的有益成分和西方资产阶级政治法律学说的基础上提出来的一项重要思想主张,其基本精神是反对封建时代的“人治”,维护资产阶级“法治”。就这一思想所涉及的内容来看,无疑是相当广泛的,虽然其中不免有一些不完善之处,也有其阶级的、历史的局限性,但它却体现了孙中山在对待古代历史遗产和学习西方问题上的正确态度,具有鲜明的时代特征和民主义色彩,不仅在许多方面超过了前人和同时代的资产阶级革命家,即使在今天看来,也不乏可借鉴的现实意义。

An Analysis of SunYat-sen's Thought About "Superiority of Law to Individual"

Law's being condescended by man" is an important thought brought forward by Sun Yat-sen on basis of inheriting the beneficial element of ancient idea of rule by law in China and the bourgeois political legal theory in the West critically. Its basic spirit is to object rule by man in feudal age and to keep bourgeois laws. As far as the content of the thought is concerned, it covers rather comprehensive. There may be some imperfect things and historic limitations of Sun's class in it, but it Shows Sun's correct attitude to ancient heritage and learning from the West, and bears vivid feature of times and democracy . In so many ways, it gets ahead of predecessor and contemporary bourgeois revolutionaries. Even now, it is of realistic importance.
