民间法视域中的人权保障

由于语言的模糊性、调控对象的单一性和法律程序的局而不终性决定了法律的有限性,切实保障人权需要其他规范类型的协力作用。民间法秩序下的人权具有文化多元性、践行性和注重集体人权等特点。民间规范对于人权之保障是通过多样化的规范类型实现的,但是也有其自身的局限性。因此,乡村社会中人权之保障应谐合法律与民间规范之作用,才能发展和完善。

The Protection of Human Rights as Seen from the Perspective of Folk Law

As law has its own limitations, the protection of human rights requires the support of other types of norms. Human rights, as seen from the perspective of folk law, are characterized by cultural diversity, practicality and stress on collective human rights. The protection of human rights is achieved via diversified civil norms which in turn have their own limitations too.
