| 摘 要： | 在我国，不利解释原则的存在是必要的，但我国《保险法》中过于原则性的规定直接导致了司法实践中对不利解释原则的滥用。我们亟需在立法和司法实践中对不利解释原则予以合理定位，明确不利解释原则适用的前提，保证司法实践中《保险法》规定的不利解释原则能得以正确地适用，从根本上保护保险合同双方的合法权益，保证保险业正常、健康地发展。
