| 摘 要： | 非政府组织的合法性问题涉及非政府组织生存和发展的前提问题,也是非政府组织与政府的基本关系问题.如果仅仅从法律标准讨论非政府组织的合法性问题,对该问题的本源和实质的分析还是不够深入和全面的.文章认为,应当从实质合法与形式合法的基本关系入手,从社会、政治、行政和法律的不同层面考察其合法性问题,才能有效解决中国非政府组织合法性的现实问题.

| Abstract: | The legitimacy problem of the NGO involves the prerequisites of the NGO's survival and development,which is also the problem of basic relationship between NGO and government.Only discussing the NGO legitimacy from the legal standard and analyzing the origin and essence of the problem are not in depth and comprehensive enough.This paper argues,starting from the basic relationships between essential legitimacy and formal legitimacy,and studying the legitimacy problem from different aspects such as society,politics,administration and law,the realistic problem could be explained and solved effectively in this field. |
