| 摘 要： | 保障和促进人权，乃是现代国家公共财政的终极价值与根本目的之所在，而保障和促进人权的事业，则绝不能无视公共财政的存在及其功能。住房权作为一项新型的权利形态和生存权的必要内涵，它的实现也必须依赖于财政税收，它的宪法保护取决于公共财政支撑的宪政制度和宪法的完善。

| Abstract: | Ensuring and promoting human rights is the ultimate value and basic purpose of modern state public property.Also,to ensure and promote human rights,we cannot ignore public property and its function.As one new right form and an essential right,the realization of housing right depends on fiscal levy.The constitution protection relies on improving the constitution and the constitutional government system of public financial support. |
