羁押必要性审查面临的现实困境及配套制度的完善

新刑事诉讼法第93条确立了捕后羁押必要性审查制度,这是我国逮捕适用控制体系中的一项新措施,体现了尊重与保障人权原则、羁押比例原则和检察监督原则,具有坚实的法理基础.但该制度面临着司法传统和法律意识、替代性措施不足、三方构造模式欠缺,以及绩效考评制度不合理等诸多问题.完善羁押替代性措施,设定科学合理的绩效考评制度,创新社会管理机制,是实现这项新制度的法律效果和社会效果相统一的重要保障.

Realistic Dilemma of the Examination of Detaining Necessity and the Perfection of Supporting Systems

The Article 93 of the New Law of Criminal Procedure stipulates the regulation for the examination of detai- ning necessity concerning arrestees, which is a new measure applicable for the controlling system about arresting. This regu- lation embodies the principles of respecting and protecting human rights,of custody proportionality and that of procuratorial supervision, thus laying a solid legitimate foundation. However, it is faced with many problems, such as the lack of the aware- ness of judicial tradition and laws, deficiency of substitutional measures, shortage of tripartie structure, and irrational system of performance evaluation, In this situation, to improve the substitutional detaining measures, establish a scientific and ra- tional system for performance evalution, and innovate the social management mechanism may turn to be the important guar- antee to achieve the unification of this ragulation＇s legal and social effects.
