女性主义运动的男性自然法背景——异性婚姻家庭制度的视角

男女两性生物学上的差异，决定了其分工与合作。在此基础上建立的异性婚姻家庭模式，隔绝了女性之间的交往和联系，未能演化出协调女性之间关系的法律系统；而男性由于其特殊的优势，在获得家庭统治权的同时，也是家庭对外的代表，他们在与其他同性的社会化交往中，演化出了适合于该性别行为特征的自然法体系。从古代自然法的柏拉图，到古典自然法的休谟，再到现代自然法的罗尔斯，他们的理论无不建立在男性的基础之上，女性则被无情地排除在外，暗含了两性之间长期的冲突。

Feminism Dancing under Male Nature Laws——Concerning the Heterosexual Marital Family Mode

Biological differences between females and males established the division and cooperation between them, based on which traditional heterosexual marital family mode separated women from their connections with the same gender and blocked any roads towards the formation of a female law system. Owing to their tight superiority, males made them both the domestic rulers and the outer deputies for the family, and thus in their social communication developed a nature law system governing the issues between a man and another man, excluding females. All the theories of nature laws, from ancient Plato＇ s to classical David Hume＇ s and then to modern John Rawls＇ , are absolutely based on men＇ s needs and designs and regardless of women＇ s, and interpret the lasting conflicts between females and males.
