基于贸易促进与环境保护相结合的立法思考和建议

从WTO宗旨与相关条文同环境保护的相关与相悖出发,深入分析了促进贸易发展又兼顾环境保护是WTO的综合目标;在对如何消除贸易与环境双向负面影响因素的基础上,提出基于贸易促进与环境保护相结合的我国立法建议。创新点在于,基于加大对世界生态环境的保护力度,提出了良好的生态环境既是一个国家人民生活水平质量高低的标志之一,也是一个国家经济可持续发展的标志之一,在此基础上,提出资源性产品和资源性产品交易等新理念,建议国际和国内立法对资源性产品交易给予特殊政策。

Legislative thinking and suggestions on the combination of trade promotion and environmental protection

Proceeding the relevancy and contradictions between the purposes and relating clauses of the World Trade Organization (WTO) and environmental protection, deeply analyzes that trade promotion as well as environmental protection are the comprehensive goal of the WTO. Out of the consideration of how to eliminate the mutual negative influences between trade and environment, proposes legislative suggestions on the basis of combining trade promotion with environmental protection in our country. From the position to strengthen the protection of the world ecological environment, emphasizes that a favorable ecological environment not only constitutes one of the indexes for the living standard and quality of a country's citizens, but also indicates the sustainable development of the country s economy. This is where the original feature of this paper lies. Based on this perspective, advances such new concepts as resource products and trading of resource products, and proposes that preferential policies be given to such trading through international and domestic legislations.
