论唐代官员的权利保障及其影响

唐代官员权利保障表现为:履行职责时享有相应的权利和工作条件,领取法定俸禄,享受法定的福利待遇;官员享有退休制度、休假制度及特殊恩惠。唐代官员权利保障机制的缺陷主要表现为:人权受损;建议权利缺乏法律保障;官员晋升机制不健全,人为因素起着主要作用;官吏缺乏保障申诉和控告的权利。唐代官员权利保障失衡带来一系列的问题,官员为确保自己的官位、仕途及生命安全,常寻求制度以外的援助,或者交结高官、权贵,或者形成同乡、同宗、座主与门生的关系,为封建国家机器的运转带来诸多负面影响。
