| 摘 要： | 超期羁押现象是刑事诉讼制度存在缺陷造成的,其根本原因是我国在立法理念上重打击犯罪,保护社会稳定,轻犯罪嫌疑人、被告人人权及其他合法权益的保护。行使羁押权力的机关,在权力的行使过程中缺少制度制约,致使权力滥用,造成超期羁押。
