| 摘 要： | 传统学说对环境侵权归责原则的解释不足。无过错责任原则并非归责原则，其实质是危险责任原则。环境侵权中仅仅适用过错责任原则难以维护受害人利益，而环境行为的异常危险性成就了危险责任原则的同时适用。
