网络名誉权的立法现状及建议

公民、法人在现实社会享有名誉权,在网络空间同样享有名誉权。由于历史文化传统等方面的原因,各国在对互联网内容的管制方面实行不同的措施。在我国,对名誉权的法律保护起步较晚,有关名誉权的保护散见于宪法、刑法、民法和最高人民法院就此所做的司法解释之中。解决网络名誉侵权纠纷,既要考虑事前预防,又要考虑事后补救,事前的预防胜于事后的补救。
