| 摘 要： | 近年来,行政法适应新的形势而有了新的发展,传统理论受到重大挑战。当前行政法的关注范围开始部分切入行政的过程本身,而非单纯外在地考察,即务实而客观的对公共服务的讨论,逐步取代主观、单纯抽象意义上的对公共利益的讨论,政府管制和制度经济学方法开始得到运用。该文考察了当前行政法的这些新发展,并注意到我国行政法内部需要重构。

| Abstract: | Recent years,the administrative law has achieved some new development,which has challenged the traditional theory.Now,the administrative law begins to give more attention to the administrative process.The discussion about public service has outbalanced the public interests.The methods of government management and system economics have come into use.Maybe it is necessary for us to reconstruct our administrative law. |
