论经济立法商谈机制对公共利益的维护

在改革开放过程中，经济立法数量急剧增加，但是经济立法领域中出现的许多问题已危害到公共利益。为规范经济立法行为，《立法法》中规定了立法机关进行立法应听取、征求公众意见的制度，以哈贝马斯的商谈理论为基础，这一制度可以界定为立法商谈机制。经济立法商谈机制的确立，可以从实现立法民主、协调经济利益和普及法制观念等三个方面维护公共利益。同时，借鉴国外的立法商谈制度的实践，我国的经济立法商谈机制应从程序、方式等方面进行完善，以更好的实现对公共利益的维护。

On Safeguarding Public Interests by Discourse Mechanism of Economic Legislation

In the course of reform and opening-up the number of economic laws and regulations is increasing rapidly. But some shortcomings in economic legislation have harmed the public interest. In order to regulate economic legislation, Legislation Law provides that the legislative authority should hear and seek the public opinions, which, based on the discourse theory of Habermas, could be defined as discourse mechanism. The establishment discourse mechanism of economic legislation can safeguard the public interests in three aspects： realizing legislative democracy, balancing economic interests and spreading sense of legality. At the same time, using the experience of other countries for reference, we should perfect the procedures and patterns of our economic discourse mechanism so that the public interests may be safeguarded better
