| 摘 要： | 反规避措施是当前美国及欧盟对外贸易法律体系中反倾销法的新发展。为规避反倾销税的适用，出口商运用零部件倾销、后期发展产品、第三国倾销等手段低于产品价值销售进口商品。反规避措施有助于消除倾销，但在另一方面被用作推行贸易保护主义的新的关税壁垒手段。本文根据当前欧美等国反规避措施不断发展的现状，力图从反规避措施的概念、范围及规避行为的确认等角度对这一新生法律现象进行粗浅的分析，并针对其中存在的消极的贸易保护主义倾向，结合我国蓬勃发展的外贸实践，提出了该法律现象对我国反倾销立法的借鉴意义和对外贸易实践的警戒意义。

| Abstract: | Anti-evading measures are new developments of anti-dumping law in current foreign trade legal system of the USA and EU.In order to evade the application of anti-dumping duties, exporters sell the imported products at less than fair value by mens of parts dumping, later period developing products, country-hopping dumping and so on. On the one hand, these measures are helpful in eliminating dumping; on the other hand, they are used as new tariff barriers to impose national trade protectionism. Based on this, the present paper has made some suggestions for anti-dumping legal system in this country. |
