我国行政潜规则的防治

摘    要:行政潜规则是指公共行政人员在权利行使中自觉或不自觉遵循的隐藏在国家法律法规下的非正式规则,它主要有隐蔽性、交易性、传染性和破坏性四种特征。本文从人性善恶、人性本位、人性求和与竞争、人性管理四个方面比较分析中西传统人性论的差异,剖析我国行政潜规则产生的人性根源。提出防治我国行政潜规则的途径:德治与法治并举,防治腐败;对群体本位的扬弃,坚持"以人为本";健全民主监督体系。

Abstract:Administrative latent rule refers to an informal rule followed by public administration officials in the exertion of rights. It has the characteristics of concealment, bribery, infectivity and destructiveness. This paper comparatively analyzes the difference of Chinese and Western traditional theory of human nature from four aspects, analyzes the humanity foundation of administrative latent rule in China, and puts forward some prevention measures.
