| 摘 要： | 职务发明制度是专利法中的一项重要制度，也一直是学界讨论的热点。此次世界金融危机说明为鼓励发明创造，实现利益平衡，必须对我国现行职务发明制度进行重构。职务发明的适用范围不合理和利益失衡，直接导致我国职务发明的数量与质量不高、职务发明非职务化现象严重和职务发明科技成果转化率低。因此，为平衡个人和单位之间的利益，可根据具体情况对职务发明相关权利进行划分，如单位享有专利申请权与专利权，而个人享有科技成果收益分享权和转化参与权。
