论宽严相济与三个刑事政策的关系

宽严相济是指惩治违法犯罪的制裁措施宽严适度,宽严协调,其政策实质是区别对待,辩证地运用"宽"与"严"。新中国成立以来,惩办与宽大相结合的基本刑事政策,在二十余年的"严打"刑事政策的高压下,实际上已成为应然的刑事政策,而且带有明显的时代政治色彩;而"严打"刑事政策则从临时的应付对策变为长期对策,事实上已取代惩办与宽大相结合的基本刑事政策而成为实然的刑事政策。由此使业已存在的中国重刑主义思想更加浓厚,已无法满足刑事司法实践的客观需要。因此,可以借鉴西方国家"轻轻重重"两极化刑事政策的有益经验,将宽严相济确立为当代中国法律制度的基本刑事政策。

The Relationship Between Justice with Mercy and the Three Penal Policies

The essence of justice with mercy is to use justice and mercy in a dialectical way.Since the founding of New China(1949-),the criminal policies of combining justice with mercy have been implemented.In the past 20 years,the severe punishment has been done,which is considered to be natural,what's more,with rich political color.The policy of severe punishment seems to have taken the place of justice with mercy,leading to more severe punishment in China,which cannot satisfy the needs of lawful practice.The"loose and severe"policies in the Western countries can be borrowed,and justice with mercy should become the basic criminal policy now in China.
