法治视野下网络反腐热的冷思考

网络反腐方便了公民对国家机关及其工作人员的监督，是宪政精神下公民通过自由言论监督国家权力的表现，但当前的网络反腐也存在着网络言论自由的虚假性、非理性、盲从性、法律依据不够明确、当事人隐私权或名誉权容易受到侵害等问题。引导网民树立法治观念，在宪法的框架内发挥网络监督的力量，是网络反腐良性发展的前提。

Reflection of Network Anti-Corruption Campaign under the Perspective of the Rule of Law

Network anti-corruption facilitates the public supervision of the state organs and their staff. And it also embodies that citizens supervise the state power through the freedom of speech under the spirit of constitutionalism. However, there exist some problems in the current network anti-corruption campaign, such as false, irrational and blind speeches, unclear laws, easy infringement of privacy and reputation, etc. It is the premise of the benign development of network anti-corruption to guide netizens to set up the concept of the rule of law and make full use of the power of network supervision under the framework of the Constitution Law.
