| 摘 要： | 文章从梳理中外法律人类学的研究成果入手 ,对该学科的相关问题进行了纲领性的论述。作者认为法律人类学的研究对象应包括两个层面 :一是法律与社会的层面 ,二是民刑法各部分法律本身的层面 ;在法律人类学的发展中 ,结构—功能主义、进化论、文化传播以及解释人类学等理论方法扮演了重要的角色 ;进入现代社会以后 ,法律人类学又提出了新法律多元理论。

| Abstract: | Based on the research achievements of legal anthropology in foreign nations and China ,the article discusses an outline of legal anthropology. The research framework of legal anthropology should include both analysis of law and society and analysis of each divisional law .Those anthropology theories such as social evolutionism,structure-functionism,diffusionism and interpretive anthropology had been important in the development process of legal anthropology.After entered modern society ,legal anthropologist offers a new legal pluralism again. |
