| 摘 要： | 行政抵抗权,是指法律赋予受无效行政行为影响的个人、组织出于对保护自身的合法权益的必需,对无效行政行为所设置的义务进行抵制和不服从的权利.探讨无效行政行为以外的另外一种行政行为作为行政抵抗权对象的可能性及相关的制度设计.

| Abstract: | Counterpart's right of resistance is the right that people who have been influenced by the invalid administrative act can resist the duty which counterpart's right of resistance created to protect their legal right by the lawful authorization.This thesis makes anther possibility of being the subject of Counterpart's right of resistance except invalid administrative act,then provides theoretic design and academic support for the construction and perfection of Chinese counterpart's right of resistance system. |
