| 摘 要： | 在考察撤案制度及运行问题之后 ,笔者提出了我国制度完善的初步思路 :应更新终止刑事案件与刑事追究的有关理念 ,加强撤案程序中的人权保障因素及恢复性 ,增加撤案申诉、撤案监督及司法审查程序 ,推进撤案程序的合理化、规范化、公开化与制度化。
