| 摘 要： | 民间标会作为一种重要的民间融资习惯,其融资优势与运行风险并存。本文首先从标会的概念特征和法律定位分析入手,然后以横跨经济法和民商法两大领域之视角来审视标会活动的法律规制问题,通过构建起相应的契约制度以及政府监管模式,以期让标会在合理的制度框架下运行,发挥积极的融资效应。
