| 摘 要： | 马克思生存哲学通过对实践的解读，揭示了现实的人是社会发展的出发点和归宿，人的自由而全面发展是理想社会的终极目标。人本法律观作为一个尊重和保障人权，实现法律服务于整个社会和全体人民的理论体系，是法律价值论、本质论、方法论的有机统一。西方人本法律观表现出一定的虚伪性和欺骗性，而人本法律观才能真正实现“以人为本”并超越西方人本法律观。人本法律观要求我们在法律实践中应当确立人本立法观、人本执法观和人本司法观。

| Abstract: | Marxist philosophy of existence reveals that actual man is the starting point and final settling place for the development of society. Man＇s free and comprehensive development is the ultimate goal for ideal society. Humanist legal viewpoint is an organic unity of law of values, the essence and methodology as a theoretical system of respecting, guaranteeing human rights and serving the whole society and people. The western humanist legal viewpoint is of duplicity and hypocritical but only humanist legal viewpoint can realize the perspective of ＂people oriented＂ ,going beyond the western humanist legal viewpoint. |
