| 摘 要： | 确定刑事诉讼中诉讼标的的单一性与同一性标准,意在彻底贯彻诉审同一原则和一事不再理原则。我国刑事诉讼法及相关司法解释对诉讼标的的单一性与同一性标准未给予应有的重视,甚至多有背离之处。

| Abstract: | The purpose of confirming the Simplicity and Similarity of the object of criminal procedure is to adhere to the principle of same charge with sance trial and the prin ciple of non-retriol of the same case.However,no attention is paid to this standard in our criminal Procedure Laus and the related judical interprefation,even with much violations. |
