可持续发展价值观对我国环境法学的挑战

可持续发展的价值取向旨在促进人类之间以及人类与自然之间的和谐,这一价值的实现取决于当代人的努力。当代人之间能否公平地分配环境保护的成本与利益,能否建立一套鼓励人们的环保行为的制度安排,这直接决定着人与自然的和谐这一价值目标的实现。我国环境法学要实现这一价值目标,必须克服观念上、法律制度层面和国际合作方面的障碍。

Challenge of Sustainable Development Values to Science of Environmental Laws of China

Orientation of sustainable development values aims at promoting harmony between mankind and that between human and nature,and its realization depends on the effort of people of contemporary generation,that is,whether people of contemporary generation can fairly distribute the cost and profit of environmental protection,and whether they can arrange for the set up of a system that encourages people's behaviours in environmental protection.The realization of this value target requires the science of environmental laws of China to overcome blocks in our understanding,in the law and system,and in international cooperation.
