| 摘 要： | 胚胎收养制度,是指胚胎的合法管理人把通过辅助生殖技术制造的剩余体外受精胚胎捐赠给其他不孕夫妇收养,同时让渡胚胎及未来出生儿童的所有权利义务的制度.胚胎收养与传统收养相比,具有成本低、怀孕控制等优势,其收养的条件和程序也具特殊性,它把传统的出生后收养制度推进到出生前的阶段,形成了收养的双轨制,为不孕夫妇组建家庭提供一种新选择.在人工辅助生殖技术业已成熟的背景下,我国可借鉴美国的成功经验和做法,建立完善的胚胎收养制度,这对完善我国家庭和亲权法制,贯彻我国计划生育国策具有十分积极的意义.
