西部开发促进法立法研究

实施西部大开发战略5年来,中央与地方均积累了丰富的实践经验,各地也探索出一些成功的模式。这些成功经验和模式为国家制定促进西部开发的法律提供了实践基础,制定法律的条件相对成熟。我们应当汲取外国开发落后地区可资借鉴的成功经验,转变立法观念,坚持“西部开发、法制先行”的原则,尽快制定出体现区域特殊性,维护西部地区人民群众根本利益,能够促进开发的强有力措施,开发与保护、开发与开放互促共进,提高西部地区自我发展能力的法律制度,为实施西部大开发战略提供法治保障。

A Study of Legislating Promotion Law for Grand Development of Western China

The Western China development strategy having been implemented for five years,both central and local governments have accumulated abundant experience,and found out some successful modes as well,which undoubtedly lay practical foundations for our country to enact laws to promote Western China development.Conditions for us to make laws are relatively at hand.We should learn from the successful and feasible experience built up by foreign countries in the course of developing backward regions,transform our legislative concept,and stick to the principle,"legal system going ahead of Western China development";we should work out forceful measures embodying regional characteristics and safeguarding the basic interests of the people in western China as soon as possible,and work out as soon as possible regime of laws making opening,protection,and development help each other,and enhancing the self-developing capacity of Western China,so as to supply judicial guarantee to implementing the Western China development strategy.
