On the Risks Influencing the Stability of Patent Right of Appearance-design and the Countermeasures

Upgrading authorization standard of patent right of appearance-design is one of the high points in the third revision of Patent Law in our country.The appearance-design should not collide with the existing prior right in applying patent right.The doctrine of automatic protection and the principle of voluntary registration will bring risks for the stability of patent right of appearance-design,therefore it is significant to explore measures to strengthen the stability of patent right of appearance-design and promote the protection.
