| 摘 要： | 朱熹的立法思想包括三个方面:主张立法主体为法自君出,君臣共议;明确立法指导思想为儒家的三纲五常;提出顺天理、合人心、衡利益、行简易、适时变等立法原则。这些观点仍具现实意义,值得当今立法积极借鉴,为构建和谐社会提供有力的法律保障。

| Abstract: | Zhu Xi's legislative ideas are of three aspects: advocating monarch as the legislator and the monarch discussing with the officials;making sure of the three cardinal guides and the five constant virtues of Confucian School as legislative guidance;putting forward some legislative principles including making law with nature and with the people,balancing the interests,advocating simplicity,and timely changing the unfitting law.These views still have practical significance.We should actively refer to Zhu Xi's legislative thought in current legislation construction in order to provide a strong legal guarantee for building a harmonious society. |
