| 摘 要： | 《合同法》的诞生堪称我国法治建设进程中迈出的又一坚实步伐,可谓是民法界的一件喜事。但是,我们仍应清醒地看到,《合同法》无论在理论上还是在立法技术上仍存在一些欠缺之处,需要改进之处甚多。笔者在学习的过程中,通过比较发现,我国《合同法》关于赠与合同的一些规定颇具特色,值得深入研究和探讨。

| Abstract: | The birth of "contract law " can be rated as another solid pace in the process of the rule of law in our country, it may be a happy event of the civil law circle. However, we must be fully aware, still there are some places deficient no matter in theory or on legislative technique in "contract law ", there are a lot of places needing improvement. In the course of study, I find some regulations about the contract of gift are quite characteristic, and it is worth of a deep study. |
