| 摘 要： | 在市场经济体制下,随着我国高等学校人事制度改革的不断深入,高等院校逐步推行教师聘任制。鉴于我国现行法律、法规对高等学校的法律地位和性质,高校与教师之间的法律关系没有清晰的界定,理论界对教师聘任合同的性质存在不同认识.难以有效解决高校与教师之间的纠纷,不利于高校的健康发展。文章对高校教师的法律地位进行思考,以此明确教师与高校之间的法律关系,规范教师聘任行为,顺利推进高校人事制度改革。

| Abstract: | In market economy, with the acceleration of human resourse management system reform in university, the teacher recruitment policy has gradually been carried out. Because of no definite regulations about the university legal status in law and doubtful legal relationship between the university and the teacher, there are so many issues about the teacher recruitment policy. It''s no help to deal with disputes between the teacher and the university. The article aims at reviewing teachers'' legal status, finding out approriate labour relations in university to regulate the teacher employment policy in law. |
