犯罪参与体系中的行为概念与行为人概念

犯罪参与体系的根本问题就在于如何理解集体现象中个人责任问题，即如何将集体现象所产生的结果归责给个人。为了解决这个根本问题，在刑事立法上发展出了两种犯罪参与的立法体系，即二元参与体系与一元参与体系。一元参与体系可以更为明确地贯彻个人责任原则，因此是更加值得采用的犯罪参与体系。

The Concept of Act and the Concept of Actor in the System of Criminal Participation

The fundamental issue in the system of criminal participation is how to solve the problem of personal responsibility in the collective phenomena,that is,how to attribute the consequences caused by collective phenomena to the individuals. To solve this fundamental issue,two different systems of criminal participation have been developed in the criminal legislation,i.e.,differentiate system and unitary system. Unitary is more reasonable since it has more alliance with the principle of personal responsibility.
