我国仲裁裁决的司法审查范围之重构

仲裁的司法监督制度是仲裁监督体系中最为重要的组成部分,也是该体系中最为有效的监督途径。而我国仲裁裁决司法监督机制并没有充分发挥其监督的功能,其中存在的重要问题之一是对仲裁裁决司法审查范围过于宽泛,导致与程序监督模式相悖。因此须重新界定仲裁裁决的审查的范围,这不仅满足了仲裁公正性和终局性的要求,更符合仲裁国际化的趋势。

Reconstructing the Judicial Review Scope of Arbitral Awards in China

Judicial Supervision of Arbitration is the most important part and the most effective means of arbitration supervision system. The current system in China substantially and broadly subjects arbitration to judicial review,which causes the inefficiency of the established arbitration regime. This model is not in compliance with the principle that mere arbitration procedure should be subject to judicial power. Therefore,it is necessary to redefine the scope of judicial reviewof arbitration,which not only meets the requirement forthe fairness and finality of arbitration,but also conforms to the trend of international arbitration.
