发展低碳经济的法律体系及其构建

发展低碳经济是我国实现可持续发展的必然选择。发展低碳经济需要完善法律保障。尽管我国为发展低碳经济已进行相关立法，但与发达国家相比，仍存在一些不足。对此，我国发展低碳经济法律体系应合理设置低碳经济立法的基本原则；加快国家战略立法，适时推出低碳经济法；构建以能源基本法为核心的能源法律体系；加强财政金融立法，充分利用市场激励机制发展低碳经济；加强科技立法，促进低碳经济科技的创新；加强消费立法，促进低碳消费模式的形成。

Developing low carbon economy is the essential choice to realize sustainable development, and requires perfect law system to support. Although China has made legislation for develop low carbon economy, there are some shortcomings compared with developed countries. Therefore, the law system of developing low carbon economy requires designing its basic principle; accelerates national strategic legislation.and puts up low carbon economy law in right times; sets up energy legal system with the core of energy Law; strengthens financial and fiscal legislation and makes full use of market incentive mechanism to develop low carbon economy; strengthens legislation of science and technology to promote technological innovation of low carbon economy; strengthens legislation of consumption to promote forming low carbon consumption mode.
