| 摘 要： | 公共利益是一个难以确定的概念，但是，为了保障权利、控制权力、社会和谐、公正司法，必须界定公共利益。界定公共利益存在诸多困难，因此需要理清几个认识前提，即任何概念的界定都不可能是至善的、界定公共利益要结合法律规范的层次性和专业性。

| Abstract: | It is hard to define what public interest is. However, it is a necessity to define it in order to guarantee people＇s rights, to control powers, to achieve the society＇s harmony and fairness of the justice. In doing so, we need to realize such presuppositions as the improbability of defining a concept utterly perfectly and the necessity of combining the levels and technicality of legal regulations. |
