| 摘 要： | 我国现行合同法导入了效益价值观 ,对原合同立法中重安全保护、轻效益追求的做法进行了合理的修正 ,将安全和效益作为自己的双重价值追求 ,可以充分发挥合同法对市场经济发展的促进作用。新合同法中的效益价值目标在合同自由、合同履行、无效界定、预期违约等制度设计中都有了具体的体现

| Abstract: | It is necessary at present that we define the beneficial result as the basic value target when we examine the contract law under market economy. The paper makes a concrete analysis of the expressions of the beneficial value target in setting the scope of freedom and performance of a contract as well as the invalid definition and possible breach of it. |
