| 摘 要： | 现代商法是企业法,企业、企业主成为现代商法的基本概念。文章从这一立法趋势出发,分析了我国企业立法的现状与内在矛盾,论证了建构适应我国经济发展现状并与国际接轨且体系完整、结构严谨的商法体系的必要性和可行性。

| Abstract: | The modern commercial law is the law of whose basic concepts are enterprise and entrepreneur. From this legislative tendency,the article analyzes the current situation and the inner contradictions of the enterprise legislation, and proves the necessity and feasibility of the construction of the commercial law system, which should meet the current economic situation of China. |
