专利市场交易价格的实质及其思考

专利市场具有双边垄断的性质.专利交易的买方根据投资收益、预期风险以及资本边际效率等因素来判断专利需求价格,而卖方根据研究成本、超额利润以及预期风险等因素判断专利供给价格,需求价格与供给价格之差形成"剩余",交易谈判实质上是对"剩余"的分割.政府促进研究与开发的落脚点就是采取各种措施使"剩余"空间增大,以刺激研究主体和开发主体的R&D的积极性.

The patent market has the feature of bilateral monopoly. The buying party of the patent transaction, on the basis of such factors as the foreseeing returns on the investment, the risk envised and the marginal revenue of the capital to be, determines the patent price while the selling party, in accordance with its research cost, the superpofit pardicted as well as the riks to come, set the patent price.Therefore there exists two different prices made by the two par- ties, which produce the surplus value. The trading negotiation for the patent transaction is actually focused upon how to separate the surplus value.The aim of the government to promote the further research of the patent and to bring it into productivity is to take various measures to broaden the space of the surplus value in order to bring in full play the initia- tive of the research and development of the patent.
