论遗产管理人监督机制的构建

设立遗产管理人的监督机制,有利于遗产分配公正、效益价值目标的实现,且在一定程度上能够预防遗产犯罪。我国应借鉴各国遗产管理人的监督立法例,从监督遗产管理人的主体及权利的设置,到重大事项报告制度,以及事后法律责任的承担等方面,构建遗产管理人监督机制。

On Establishment of Supervision Mechanism for Administrator of the Estate

To establish a supervising system for administrator of the estate is conducive to the fair distribution of heritage and the realization of profit value. And to some extent,it can prevent heritage-related crime. In this sense,China’s supervision system for administrator of the estate can be constructed,according to the author,by learning from foreign legislations,from the supervision over the confirmation of the subject and rights in heritage management,to system for reportings of major events,and to the legal liabilities that the administrators have to undertake after the events.
