摘    要:住宅小区的配套设施、绿地、楼顶平台、停车场、悬挂广告牌和安装防盗栅的权利应归全小区所有人共有或准共有 ,相应地 ,房地产开发商负有全部转让其房地产权属的义务。而国家则应从外部保障房地产交易安全、有序地进行 ,对房地产的权属登记采取实质审查制。

Abstract:The right to use facilities, greenbelt, roof gardens, parking lots and to mount billboard and bars against theft should belong to the all residents in the residential district. Accordingly, these rights should be transferred from the developers to the residents. Meanwhile the state should guarantee the business of real estate by lawmaking and implement essential examination to real estates' rights records.
