对“无限防卫权”法律规定的反思

我国新刑法关于无限防卫权的规定有悖于权利有限说 ,容易弱化对不法侵害者应有合法权益的保护 ,诱发更严重的暴力犯罪 ,导致防卫人与犯罪人两败俱伤的结果 ,也不符合国际社会防卫权发展的总趋势。在司法实践中 ,应限制这一权利的行使。

Reflections on the Legal Provisions about the "Right to Non-limited Defense"

Considering the evolution of self defense and relevant modern criminal rules in other countries and basing on valuing the positive meaning of limitless rights of defense in the new criminal code,this article will demonstrate the that stipulation of rights to non limited defence is opposite to the doctrine of limited rights,will easily weaken the protection of violators legal rights and stimulate more serious crimes of violence and lead to the damages to both defender and violator,and this is incompatible with the trend in the development of the right to self defense in the world.Therefore,it suggests restricting the enforcement of non rights in the judicial activities.
